杭州首起电商恶意投诉案宣判

2019年1月24日,杭州互联网法院审理了一起不正当竞争纠纷。该案是《电子商务法》生效以来,杭州互联网地法院作出的首例判决。

本案原告在淘宝上经营着一家运动服饰网店。2016年12月31日,经营相同品牌网店的被告,利用伪造的授权文件、商标注册证书,并投诉原告经营的商品。因遭恶意投诉,原告店铺的流量下降,信誉受损,造成了重大经济损失。杭州互联网法院认为,原告和被告具有为直接竞争关系,被告的恶意投诉行为导致了原告遭受了实际损失,构成不正当竞争。据此,法院判决被告承担赔偿责任,赔偿原告经济损失210万元,并驳回原告其余诉讼请求。

First Unfair Competition Case Ruled by Hangzhou Internet Court

On 24 January 2019, the Hangzhou Internet Court heard an unfair competition case concerning online trading. The judgment is the Court’s first judgment under the E-commerce Law, which came into effect on 1 January 2019.

The Plaintiff ran an online sportswear store on Taobao. The Defendant also ran an online store.  It used the Plaintiff’s brand on its site and displayed forged authorization documents and trademark registration certificates.  As a result, the Plaintiff’s reputation suffered and its sales declined.  The Hangzhou Internet Court held that the Plaintiff and the Defendant were in a directly competitive relationship. The Defendant's malicious activity caused actual loss to the Plaintiff and amounted to unfair competition. Accordingly, the Court ordered the Defendant to compensate the Plaintiff for economic loss of RMB 2.1 million (approx. US$ 311,745).

 

全国首例电商平台诉差评师案一审宣判

曾在电商平台滥用评价权、恶意敲诈勒索商家的杜某等3人在受到刑事处罚后,又被淘宝公司诉至法院。2019年1月17日,江苏省海门市人民法院对这起全国首例电商平台诉差评师案,作出一审判决,被告杜某等3人的行为损害了淘宝公司的合法民事权益,判决3人共同赔偿淘宝公司损失1元、合理支出2万元。

海门法院经审理认为,淘宝网平台上的销量、评价等数据经过长期交易积累而形成,信用评价体系是淘宝网核心竞争利益,法院有理由相信该平台上的消费者在网络购物决策过程中已养成对信用评价数据的依赖和习惯。三名被告以敲诈为目的对商家进行恶意差评,客观造成淘宝平台上相关数据的不真实,直接影响并破坏了其构建的信用评价体系,亦即损害了淘宝公司合法的民事权益。

Haimen Court Rules against Group regularly placing Malicious Product Reviews on E-commerce Platform

On 24 January 2019, Taobao brought an action against three Defendants in the Jiangsu Province Haimen City People's Court for having deliberately published negative reviews of the products of certain merchants and then proceeded to blackmail the merchants concerned.  The group regularly engaged in the practice as a way of making money. The Court ordered the three Defendants to compensate the Plaintiff for economic loss in the sum of RMB 1 and for reasonable expenditure in the sum of RMB 20,000 (approx. US$2,972).

The Court held that data relating to sales and consumer ratings are core competitive property for Taobao. Taobao has reasonable grounds for believing that consumers make purchasing decisions on the basis of other consumers' feedback. The Defendants have deliberately made negative comments in relation to some products, destroying the credibility of the Plaintiff’s sales data, and, as a result, damaging the legitimate interests of the Plaintiff.

 

美的专利侵权案一审有果

近日,广州知识产权法院对佛山市顺德区美的洗涤电器制造有限公司(下称美的公司)诉佛山市百斯特电器科技有限公司(下称百斯特公司)侵犯实用新型专利权纠纷一案作出判决。原告诉称,涉案名称为“用于洗碗机的加热棒和洗碗机”的实用新型专利权产品(下称涉案专利)是系由原告合法拥有的洗碗机的重点技术,被告制造、销售和许诺销售的洗碗机落入涉案专利权利要求的保护范围,故提起诉讼。

法院经审理认为,百斯特公司生产、销售、许诺销售的洗碗机相关产品落入了涉案专利的权利要求保护范围,且针对涉案专利提起的无效宣告请求被驳回,故应承担相应的侵权责任。法院判令百斯特公司应立即停止侵权,并赔偿美的公司经济损失及合理开支共计100万元。

Foshan Midia Wins Utility Model Patent Infringement Case at First Instance

Recently, the Guangzhou Intellectual Property Court handed down its decision in a case concerning the alleged infringement of a utility model patent: Foshan Midea Electric Appliances Co. Ltd (Media) and Foshan Best Electronics Technical Co., Ltd (Best). The Plaintiff, Midia, claimed that the Defendant (Best) had infringed its utility model patent for a heating rod used in dishwashers. 

The Court held that since the Defendant’s application to invalidate the utility model patent had been rejected, it was liable for infringement.  It had manufactured, sold and promised to sell dishwashers that fell within the scope of the utility model patent claims. The Court ordered Best to cease the infringement immediately, and compensate Midia for economic losses and reasonable expenses totalling RMB 1 million (approx. US$ 148,610).

 

“蒙奇奇”发起401万元侵权诉讼

人气玩偶“Monchhichi”(蒙奇奇)制造商“有限公司关口”(SEKIGUCHI CO., LTD.)因认为自己享有的商标权和著作权受到侵犯,分别以侵犯商标权以及著作权为由,向天津市第一中级人民法院起诉天津市蒙奇奇新天地咖啡有限公司、蒙奇奇品牌管理(天津)有限公司、蒙奇奇餐饮(天津)有限公司、东莞市谦晟塑胶模具有限公司、天津恒隆地产有限公司、孙某、肖某,请求立即停止侵犯原告享有的在先商标权,销毁侵权产品、停止提供侵权服务,关闭侵权咖啡门店等;两案共索赔401万元。

Monchhichi Doll Manufacturer Claims RMB 4.01 Million for Trademark and Copyright Infringement

Sekiguchi Co., Ltd,  manufacturer of the popular Mochhichi doll, has brought trademark and copyright infringement proceedings in the Tianjin First Intermediate People’s Court against seven Defendants:  Tianjin Mochhich Xintiandi Coffee Co., Ltd., Mochhich Brand Management (Tianjin) Co., Ltd. Mochhich Restaurant (Tianjin) Co., Ltd., Dongguan Qianyi Plastic Mould Co., Ltd., Tianjin Henglong Real Estate Co., Ltd., Sun, Xiao.

The Plaintiff has requested the Court to order the Defendants to cease the infringement, i.e. cease the supply of relevant products or the provision of relevant services; destroy all infringing products; and close all relevant shops, etc. The Plaintiff is also claiming compensation in the sum of RMB 4.01 million (approx. US$ 595,926).
